SPIRIT Core Social Terms of Use
These Terms of Use (hereinafter referred to as “these Terms”) set forth the conditions for the use of SPIRIT Core Social (hereinafter referred to as “this Service”). All persons who use this Service, including viewers (hereinafter referred to as “Users”), shall be deemed to have agreed to these Terms.
This Service is an experimental instance operated by SPIRIT -FringeScienceTEAM- (hereinafter referred to as “the Operator”) as an individual and small team. It is operated as a place for experimentation and verification on various themes such as AI, engineering, music, and social systems, with the aim of exploring the boundary between cutting-edge technology and human sensitivity. It is not intended to be a large-scale, publicly available service for the general public.
Article 1 (Application)
1. These Terms shall apply to all relationships between the Operator and Users with respect to the provision and use of this Service.
2. The Operator may establish guidelines, rules, and other provisions regarding the use of this Service (hereinafter collectively referred to as “Individual Rules”) in addition to these Terms. Regardless of their names, such Individual Rules shall constitute a part of these Terms.
3. In the event of any inconsistency between the contents of these Terms and any Individual Rules, the Individual Rules shall prevail unless otherwise specifically provided therein.
Article 2 (Accounts)
1. Use of certain functions of this Service may require account registration.
2. In principle, registration for this Service shall be by invitation or with the approval of the Operator. Unauthorized registration by third parties, mass registrations, or registrations for the purpose of spam are prohibited.
3. Users shall provide true and accurate information at the time of registration and shall keep such information up to date at all times.
4. Users shall be responsible for managing their own account information (including passwords) and shall not allow any third party to use their accounts.
5. Any and all actions performed through an account shall be deemed to have been performed by the User who holds that account.
Article 3 (Prohibited Acts)
Users shall not engage in any of the following acts when using this Service:
1. Acts that violate laws or public order and morals
2. Acts involving discriminatory expressions, violent expressions, excessive insults, defamation, threats, harassment, or any other acts that cause disadvantage or discomfort to others
3. Acts that infringe upon the rights of others, including but not limited to copyrights, trademark rights, portrait rights, privacy rights, and rights of reputation
4. Spam acts, multi-posting, or mass posting/following using bots or other automated means
5. Unauthorized access or attempts to gain such access
6. Exploiting vulnerabilities of this Service or other services, or improperly spreading such information
7. Acts that unjustifiably increase the load on this Service or external services
8. Use of this Service primarily for excessive advertising, promotion, affiliate solicitation, multi-level marketing, network business, or speculative investment solicitation
9. Financial or investment activities that violate laws, or acts that encourage such activities
10. Posting content that is harmful to minors, or acts that encourage such posting
11. Impersonation of others, registration or posting using false information, or unauthorized use of another person’s account or data
12. Acts that interfere with the operation of this Service or that may do so
13. Any other acts that the Operator deems inappropriate
Article 4 (Handling of Content)
1. The copyright in content posted by Users on this Service (including, but not limited to, text, images, audio, and video; hereinafter referred to as “Posted Data”) shall, in principle, belong to the respective Users.
2. Users grant the Operator the right, free of charge, to use Posted Data to the extent necessary for the operation, display, storage, backup, technical verification, and distribution to other instances via federation protocols (such as ActivityPub) of this Service.
3. Users represent and warrant that their Posted Data does not infringe upon any rights of third parties. In the event of any dispute with a third party, the User shall resolve such dispute at the User’s own responsibility and expense.
4. The Operator may, without prior notice, delete, make private, or partially modify Posted Data, or take any other measures deemed necessary, if the Operator determines that such data violates or is likely to violate these Terms.
Article 5 (Notes on Federation)
1. This Service may federate with other servers (instances) through federation protocols such as ActivityPub.
2. Content posted as public or as subject to federation may be copied and stored on other instances, and the Operator cannot guarantee the complete deletion or erasure of such content.
3. Even if a User deletes their account or posts, the deletion or hiding of copied data on federated instances is subject to the policies of such instances, and the Operator does not guarantee such deletion or hiding.
4. Users shall use this Service with an understanding of these characteristics of federation.
Article 6 (Changes, Suspension, or Termination of Service)
1. The Operator may change, suspend, or terminate all or part of this Service without prior notice to Users if the Operator determines that any of the following applies:
1) When performing maintenance or emergency work on servers, networks, or systems
2) When operation of this Service becomes difficult due to fire, power outage, natural disaster, epidemic, or other force majeure events
3) When changes in the specifications or failures of external services or infrastructures make it difficult to provide this Service
4) When the Operator determines that it is difficult to continue this Service due to the Operator’s circumstances
2. The Operator shall not be liable for any damage incurred by Users due to changes, suspension, or termination of this Service.
Article 7 (Disclaimer)
1. This Service is provided on an “as-is” basis, and the Operator makes no warranties, express or implied, regarding the suitability for a particular purpose, safety, completeness, accuracy, usefulness, or continuity of this Service.
2. Users shall make their own decisions and act at their own responsibility in selecting and using information in connection with the use of this Service.
3. The Operator shall not be liable for any trouble or dispute arising between Users or between a User and a third party.
4. The Operator shall not be liable for any damage suffered by Users arising from the use or inability to use this Service (including, but not limited to, indirect, special, consequential, or incidental damages and lost profits), except in cases where such damage is caused by the Operator’s willful misconduct or gross negligence.
Article 8 (Suspension or Deletion of Accounts)
1. If the Operator determines that a User has violated or is likely to violate these Terms, the Operator may, without prior notice, take necessary measures such as temporary suspension, permanent suspension, or deletion of the User’s account, or deletion of Posted Data.
2. Users may request deletion of their accounts in the manner prescribed by the Operator. However, as stipulated in the preceding Article and Article 5, the Operator does not guarantee the deletion of data copied to federated instances.
Article 9 (Amendment of Terms)
1. The Operator may amend these Terms whenever deemed necessary.
2. When amending these Terms, the Operator shall notify Users of the details of the amendments and the effective date by posting on this Service or by other methods deemed appropriate by the Operator.
3. In the event that a User uses this Service after the amendment of these Terms, the User shall be deemed to have agreed to the amended Terms.
Article 10 (Governing Law and Jurisdiction)
1. The interpretation and application of these Terms shall be governed by the laws of Japan.
2. In the event that any dispute arises between the Operator and a User in connection with this Service, the parties shall attempt to resolve the dispute through consultation, and if the dispute cannot be resolved, the court having jurisdiction over the principal place of business of the Operator in Japan shall be the exclusive court of first instance by agreement.
Supplementary Provision
These Terms shall come into effect on November 24, 2025.

本利用規約（以下「本規約」といいます。）は、SPIRIT Core Social（以下「本サービス」といいます。）の利用条件を定めるものです。本サービスを利用するすべての方（閲覧のみを含み、以下「利用者」といいます。）は、本規約に同意したものとみなされます。
本サービスは、SPIRIT -FringeScienceTEAM-（以下「運営者」といいます。）が個人および小規模チームにより運営する、実験的なインスタンスです。最先端技術と人間の感性のあいだを探ることを目的とし、AI・エンジニアリング・音楽・社会システムなど、さまざまなテーマを試行・検証する場として運用されています。大規模な一般公開サービスを想定したものではありません。
第1条（適用）
1. 本規約は、本サービスの提供および利用に関する運営者と利用者との一切の関係に適用されます。
2. 運営者は、本サービスに関して、本規約のほか、ガイドライン・ルール等（以下「個別規定」といいます。）を定めることがあります。個別規定は、その名称のいかんを問わず、本規約の一部を構成するものとします。
3. 本規約と個別規定の内容が矛盾する場合は、個別規定に特段の定めがない限り、個別規定が優先して適用されます。
第2条（アカウント）
1. 本サービスの一部機能の利用には、アカウント登録が必要となる場合があります。
2. 本サービスの登録は、原則として招待制または運営者による承認制とします。第三者による無断登録や大量登録、スパムを目的とした登録は禁止されます。
3. 利用者は、登録に際して真実かつ正確な情報を提供し、常に最新の状態に保つものとします。
4. 利用者は、自らの責任においてアカウント情報（パスワードを含みます。）を管理し、第三者に利用させてはなりません。
5. アカウントを通じて行われた一切の行為は、当該アカウントを保有する利用者本人の行為とみなされます。
第3条（禁止行為）
利用者は、本サービスの利用にあたり、以下の行為を行ってはなりません。
1. 法令または公序良俗に違反する行為
2. 差別的表現、暴力的表現、過度の侮辱、誹謗中傷、脅迫、いやがらせその他、他者に不利益または不快感を与える行為
3. 他者の権利（著作権、商標権、肖像権、プライバシー権、名誉権その他一切の権利）を侵害する行為
4. スパム行為、マルチポスト、ボット等を利用した大量投稿・フォロー行為
5. 不正アクセス、またはそれを試みる行為
6. サービスの脆弱性を悪用する行為、またはその情報を不適切に拡散する行為
7. 本サービスまたは外部サービスの負荷を不当に増大させる行為
8. 過度な広告・宣伝・アフィリエイト勧誘・マルチ商法・ネットワークビジネス・投機的な投資勧誘等を主目的とする利用
9. 法令に違反する金融・投資行為、もしくはそれを助長する行為
10. 未成年の保護に反する内容の投稿や、それを助長する行為
11. なりすまし、虚偽の情報による登録・投稿、または他者のアカウント・データの不正利用
12. 本サービスの運営を妨害し、またはそのおそれのある行為
13. その他、運営者が不適切と判断する行為
第4条（コンテンツの取り扱い）
1. 利用者が本サービスに投稿したコンテンツ（テキスト、画像、音声、動画その他一切を含みます。以下「投稿データ」といいます。）の著作権は、原則として当該利用者に帰属します。
2. 利用者は、運営者に対し、本サービスの運営、表示、保存、バックアップ、技術検証、および連合プロトコル（ActivityPub 等）による他インスタンスへの配信に必要な範囲で、投稿データを無償で利用する権利を許諾するものとします。
3. 利用者は、投稿データが第三者の権利を侵害していないことを保証します。第三者との間で紛争が生じた場合、利用者は自己の責任と負担においてこれを解決するものとします。
4. 運営者は、本規約違反またはそのおそれがあると判断した投稿データについて、事前の通知なく削除・非公開化・一部修正その他必要な措置を行うことができます。
第5条（連合に関する注意）
1. 本サービスは、ActivityPub 等の連合プロトコルを通じて、他のサーバー（インスタンス）と連携する場合があります。
2. 公開または連合対象として投稿されたコンテンツは、他インスタンスに複製・保存されることがあり、その完全な削除や消去を運営者が保証することはできません。
3. 利用者がアカウント削除や投稿削除を行った場合でも、連合先インスタンス側に複製されたデータについては、当該インスタンスのポリシーに従うものであり、運営者はその削除・非表示を保証しません。
4. 利用者は、このような連合の特性を理解した上で、本サービスを利用するものとします。
第6条（サービス内容の変更・中断・終了）
1. 運営者は、以下のいずれかに該当すると判断した場合、利用者への事前通知なく、本サービスの全部または一部の提供を変更、中断または終了することができます。
1) サーバー・ネットワーク・システムの保守または緊急対応を行う場合
2) 火災、停電、天災、感染症の流行その他の不可抗力により、本サービスの運営が困難になった場合
3) 外部サービスやインフラの仕様変更・障害等により、本サービスの提供が困難になった場合
4) 運営者の事情により、本サービスの継続が困難であると判断した場合
2. 運営者は、本サービスの変更・中断・終了により利用者に生じた損害について、一切の責任を負わないものとします。
第7条（免責事項）
1. 本サービスは「現状有姿」で提供されるものであり、運営者は、本サービスについて、利用目的への適合性、安全性、完全性、正確性、有用性、継続性等について、明示または黙示を問わずいかなる保証も行いません。
2. 利用者は、本サービスの利用に伴い、自らの判断と責任において情報を取捨選択し、行動するものとします。
3. 利用者間または利用者と第三者との間で生じたトラブル・紛争等について、運営者は一切の責任を負いません。
4. 本サービスの利用または利用不能により利用者に生じた損害（間接損害、特別損害、結果的損害、逸失利益を含みます。）について、運営者は、故意または重過失がある場合を除き、一切の責任を負わないものとします。
第8条（アカウントの停止・削除等）
1. 運営者は、利用者が本規約に違反した場合、またはそのおそれがあると判断した場合、事前の通知なく、当該利用者のアカウントの一時停止、永続停止、投稿データの削除その他必要な措置を講じることができます。
2. 利用者は、運営者が定める方法により、自己のアカウント削除を申請することができます。ただし、前条および第5条に定めるとおり、連合先インスタンス等に複製されたデータの削除について運営者は保証しません。
第9条（規約の変更）
1. 運営者は、必要と判断した場合、本規約を変更することができます。
2. 本規約を変更する場合、運営者は、本サービス上での掲示その他運営者が適切と判断する方法により、変更内容および効力発生日を周知します。
3. 変更後に利用者が本サービスを利用した場合、利用者は変更後の規約に同意したものとみなされます。
第10条（準拠法・管轄）
1. 本規約の解釈および適用には、日本法を準拠法とします。
2. 本サービスに関して運営者と利用者との間で紛争が生じた場合、運営者の主たる拠点所在地を管轄する日本の裁判所を、第一審の専属的合意管轄裁判所とします。
附則

3-3. Data from other servers (Fediverse)
Because the Service is part of a federated network:
- When users on remote servers follow you or interact with your content, copies of your public or shared content may be stored on those remote servers.
- We may receive profile information and public posts from other servers when you follow or interact with users on those servers.
Each remote server has its own privacy policy. We cannot control how other servers handle your data.
4. How We Use Your Data
We use collected data for the following purposes:
- To provide, operate, and maintain the Service
- To authenticate users and manage accounts
- To deliver timelines, posts, notifications, and other core features
- To prevent abuse, spam, and security incidents, and to respond to reports

- フォームや問い合わせ等を通じて、ユーザーが任意で提供したその他の情報
3-2. 自動的に取得されるデータ
本サービスへのアクセス時に、当運営は以下の情報を自動的に取得する場合があります。
- 技術情報：IPアドレス、ブラウザの種類、端末情報、OS、言語設定 など
- 利用状況情報：アクセスログ、閲覧ページ、投稿・リアクション・フォロー等の操作履歴、アクセス日時 など
- ログイン状態の維持や表示設定のためのクッキー等の技術情報
3-3. 他サーバー（Fediverse）から取得するデータ
本サービスは分散型SNSの連合ネットワークの一部であるため、
- 他サーバーのユーザーがあなたをフォローしたり、あなたの投稿へリアクション・返信を行ったりすると、その公開コンテンツのコピーが他サーバーに保存される場合があります。
- あなたが他サーバーのユーザーをフォローしたり、やり取りしたりする際に、そのユーザーのプロフィール情報や公開投稿が当サーバーに取得されます。
他サーバーにおけるデータの取扱いは、それぞれのサーバーのポリシーに従います。当運営が管理・制御することはできません。
4. データの利用目的
当運営は、取得したデータを以下の目的で利用します。
- 本サービスの提供・運営・維持のため
- ユーザー認証およびアカウント管理のため
- タイムライン、投稿、通知などの各機能を提供するため
- 迷惑行為・スパム・不正アクセス等の防止および通報への対応のため
- パフォーマンス監視、不具合の調査、安定運用の改善のため
- 法令上の義務を履行し、当局からの正当な要請に応じるため
- AI・エンジニアリング・音楽・社会システム等に関する研究・実験・開発を行うため

当運営は、取得した個人データを第三者に販売することはありません。
5. 法的根拠（EEA・英国等の地域のユーザー向け）

6. データの共有
6-1. Fediverse 内での共有
あなたが投稿を「公開」等の連合対象として投稿した場合、
- その投稿・プロフィール・関連メタデータは、複数の外部サーバーに配信・保存されることがあります。
- 一度連合されたデータについては、すべての外部サーバーからの完全な削除を保証することはできません。
6-2. 業務委託先等のサービスプロバイダ
当運営は、次のような業務を委託するために、必要最小限のデータを外部事業者と共有する場合があります。
- サーバー・インフラの提供
- バックアップおよびストレージサービス
- 監視・セキュリティ関連サービス など
これらの事業者は、当運営との契約に基づき、当該業務の遂行に必要な範囲でのみデータを取り扱います。
6-3. 法令等に基づく開示
当運営は、次の場合に個人データを開示することがあります。
- 法令や裁判手続きに従うために必要と判断される場合
- 当運営または第三者の権利・財産・安全を保護するために合理的に必要な場合
- 公的機関からの正当な要請に応じる場合
7. データの保存期間

8. クッキー等の利用

- ログイン状態の維持
- 表示設定や言語設定などの保存
- 迷惑行為や不正アクセスの防止
ブラウザの設定によりクッキーを制御できますが、必須クッキーを無効化すると、一部機能が利用できなくなる場合があります。

10. 未成年の利用について
本サービスは、主として成人およびプロジェクト関係者を対象としています。
未成年者による利用について、保護者の同意なく個人データが提供されたことを確認した場合、当運営は合理的な範囲でそのデータの削除等の対応を行います。
